Crescenz VA Medical Center (CMCVAMC) is seeking an Indefinite Delivery Indefinite Quantity (IDIQ) contract for Diagnostic Radiologist (DR) and Nuclear Medicine (NM) Radiologist. The objective of this contract is to secure qualified, credentialed radiologist physicians to provide diagnostic imaging interpretation services in support of uninterrupted patient care. Contracted radiologists will ensure timely, accurate, and clinically relevant interpretations of imaging studies, maintain compliance with institutional policies and regulatory standards, and collaborate effectively with referring clinicians and imaging staff. This staffing support is intended to address current gaps due to provider attrition while maintaining service continuity, quality of care, and operational efficiency within Diagnostic Radiology and Nuclear Medicine Services. This Performance Work Statement (PWS) outlines the requirements, expectations, and deliverables for contracting qualified Radiologists to provide diagnostic imaging services at CMCVAMC, part of the Department of Veterans Affairs. The goal is to ensure timely and accurate radiological interpretations to support high-quality patient care. 2. BACKGROUND: Physician personnel shortages and turnover in the Diagnostic Radiology and Nuclear Medicine Services of the CMCVAMC have created a significant need for increased professional diagnostic interpretive capacity to ensure consistent availability of imaging examinations for our Veterans, both routine and emergent. Contracted Radiologist will provide final radiology interpretations for exams performed during regular tours when existing radiologist services are unavailable or insufficient to meet the clinical demand. The use of image service outsourcing should provide a highly cost-effective and expeditious alternative to meet ongoing needs within the CMCVAMC. The CMCVAMC uses electronic image and health record management and distribution systems including Computerized Patient Record System (CPRS), Veterans Health Information Systems and Technology Architecture (VISTA) Imaging, Philips Intelli space, Picture Archiving and Communication System (PACS), and Nuance Power scribe. Without timely intervention, this attrition threatens to compromise diagnostic turnaround times, patient care quality and departmental efficiency. 3. Scope of Work: The Contractor shall provide board certified/eligible Radiologist as needed by CMCVAMC. Those services will primarily be needed on Monday, Tuesday, Wednesday, Thursday and/or Friday 8am-4:30pm. The Contractor is required to maintain a sufficient pool of qualified radiologists to ensure timely and efficient delivery of radiological services. All imaging studies shall be interpreted exclusively by radiologists who have been appropriately credentialed and privileged in accordance with the agency s medical staff bylaws, credentialing policies, and applicable regulatory standards. Interpret diagnostic imaging studies (General Radiology, Ultrasound, Magnetic Resonance Imaging (MRI), Nuclear Medicine (NM), PET CT, Computed Tomography (CT) Scan, Mammography) in alignment with current departmental workflows. The contract Radiologist must possess the necessary qualifications to perform Fluoroscopic exams competently and in accordance with CMCVAMC standards. Maintain existing turnaround time standards and quality benchmarks. Participate in clinical consultations and multidisciplinary case discussions as needed. Support educational activities if applicable (e.g. resident/fellow teaching). The contract Radiologist must provide oversight and teaching to the house staff of our academic affiliates. Adhere to CMCVAMC documentation, compliance, and reporting protocols. The Contractor shall adhere to all applicable agency policies and procedures regarding the reporting of imaging examinations, the assignment and use of diagnostic codes, and the timely and appropriate communication of results to referring providers and clinical teams. Radiologists shall be available for clinical consultation regarding imaging examinations and shall provide evidence-based recommendations for additional or alternative diagnostic procedures to referring clinicians as appropriate. All imaging examinations for inpatients, emergency department patients, and other cases designated as urgent shall be classified as STAT. The Contractor shall interpret and finalize reports for such STAT studies within one (1) hour of receipt of the examination, in accordance with institutional standards for emergent care. Technologists performing imaging procedures intended for interpretation may consult the contractor for guidance regarding examination protocols, evaluation of potential contrast allergies, or direction in the event of unexpected or abnormal findings, to ensure safe and accurate diagnostic outcomes. The Radiologist will communicate critical results to the ordering practitioner or surrogate practitioner immediately during interpretation, but at least within an hour of detecting the finding. Contracted Radiologist must have a minimum of three years of experience. When clinically indicated, radiologic interpretations shall include a comparison with relevant prior imaging studies to support accurate diagnosis and continuity of care. If a preliminary interpretation is first rendered, then the Radiologist providing the final interpretation must determine whether the final report is different from the preliminary interpretation. Any change or discrepancy between the preliminary and final interpretations must be documented in the report and communicated to the referring clinician or their coverage surrogate. The date and time of that communication must be documented in the final report. Stroke Protocol Examinations. The Contractor will perform expedited imaging interpretations of Non-Contrast Head CT studies for patients presenting within the eligible time window for alteplase administration of those within the extended time window for endovascular treatment. The final written report will be noted in CPRS within 30 minutes of study. Intraoperative Radiographs. The Contractor will perform expedited imaging interpretations for intraoperative radiographs in support of VHA Directive 1103 Prevention of Retained Surgical Items or other intraoperative radiographs requiring emergent radiologist interpretation in support of clinical decision making while the patient is in the operating room. The contractor will provide interpretations within 30 minutes of the completed study. The Contractor will provide direct callbacks on these OR cases. 4. DOCUMENTATION All image interpretations will either meet or exceed established standards of care in timeliness, accuracy, and content. Each report will identify the study technique, images reviewed, relevant comparisons, objective findings, the Radiologist s impression of the patient s condition, and recommendation for treatment. All reports are to be in accordance with American College of Radiology (ACR) standards. Interpretations must include the following information (it is acceptable for some of this information to be included in the electronic headers and metadata): patient s full name, SSN, date of birth, reason for study, exam case n umber (accession number), date of study, date of interpretation, requesting physician, relevant comparisons, study technique, laterality when applicable, description of the exam and findings (body of the report), impression, diagnostic codes, name of interpreter, and signature of Radiologist providing the interpretation. The report shall list pertinent positive and negative findings. Only CMCVAMC approved abbreviations will be used for documentation of the patient health record. This policy may be updated by the CMCVAMC from time to time. The contract Radiologist will be provided with updated versions if their usage changes. The contract Radiologist will code all studies (both normal and abnormal studies) with a diagnostic code which is inserted at the time of report generation. The diagnostic codes and their usage may be updated from time to time. The contract Radiologist will be provided with updated instructions if their usage changes. 5. CONTRACTOR REQUIREMENTS The Contractor shall provide all services specified in this contract for any person determined eligible by the Chief of Staff or the Chief Diagnostic Radiology, regardless of the race, color, religion, sex, or national origin of the person for whom such services are ordered. The Contractor further warrants that he/she will not resort to subcontracting as a means of circumventing this provision. 6. DELIVERABLES Consistent interpretation of imaging studies at current volume levels. Timely and accurate Interpretation of imaging studies Finalized Radiology Reports STAT and Urgent Case Coverage Comparative Analysis When clinically indicated, interpretations must include comparison with prior imaging studies to support diagnostic accuracy Consultation availability Protocol oversight and guidance Credentialing and compliance Radiologists must maintain current licensure, credentialing, and privileges in accordance with CMCVAMC and regulatory requirements. STAFFING REQUIREMENTS Licensure and Certification Must hold an active, unrestricted medical license in the state of practice. Board-certified or board-eligible in diagnostic radiology by the American Board of Radiology (ABR) Credentialing and Privileging Must be fully credentialed and privileged by CMCVAMC in accordance with medical staff bylaws and Joint Commission standards. Clinical Competency Demonstrated proficiency in interpreting a broad range of imaging modalities. 8. MEDICAL RECORDS STANDARDS The Contractor shall comply with the Medical Record Compliance Standards of the VHA. Medical center staff will provide Privacy Act training to appropriate contractor staff. The contractor employees shall be subject to the Privacy Act of 1974 and HIPAA of 1996. The CMCVAMC is the sole entity authorized to release information upon written request submitted via facsimile or mail from the patient. The CMCVAMC will provide the Contractor with access to pertinent patient medical information, within the existing privacy rules and regulations for the purpose of providing coordinated comprehensive primary care. Contractors shall ensure the confidentiality of all patient information and shall be held liable in the event of the breach of confidentiality. 9. CMC VA Medical Center shall be responsible for: CMCVAMC will be responsible for credentialing doctors to work in a timely fashion. An application package will be provided by the CMCVAMC to be completed by the candidate. This includes Curriculum vitae, current references, signed release of information from candidate, and statement that candidate does not have any physical or mental conditions that would adversely affect his/her ability to carry out assigned duties, and additional credentialing and privileging forms. Candidate will also be required to make application through the VET-PRO Internet process. Candidate will need to be enrolled in VET-PRO by the Credentialing and Privileging Coordinators. GUIDELINES The Contractor will perform the functions required under this contract in accordance with the rules of medical ethics, Federal, State and local laws, rules and regulations, Joint Commission, and American College of Radiology (ACR) for communication. The Contractor will not participate nor be a party to any activities, which conflict with Federal and/or State guidelines. In the event the Contractor encounters said conflicting situations, the Contractor will notify the COR or the Contracting Officer to resolve such issues. Neither the CMCVAMC nor the Contractor will be responsible for any delays or failures to perform due to causes beyond each party s control. The CMCVAMC and the Contractor may upon mutual consent, modify the timing and schedule of services. 11. CONTRACTOR STANDARDS The Contractor must possess all licenses, permits, accreditation and certificates as required by law. The Contractor must perform the required work in accordance with Joint Commission, VHA and other regulatory standards. Joint Commission standards may be obtained from the Joint Commission on Accreditation of Healthcare Organization. 12. QUALIFICATIONS The Contractor will be responsible to ensure that Contractor personnel providing work under this contract are fully trained and completely competent to perform the required work. Providers must present appropriate credentialing information including, but not limited to, the following: Possess the M.D. (medical doctor) or O.D. (Doctor of Osteopathic Medicine) degree Board certification or eligibility in Diagnostic Radiology by the American Board of Radiology Current licensure Clinical practice experience of at least three years The contractor must maintain and provide proof of current malpractice insurance coverage for all personnel involved in the provision of services under this contract. It is imperative that the provider bear full responsibility for the procurement and maintenance of this insurance to safeguard against any claims or liabilities arising from the performance of their duties. Radiologists will only interpret those study types and modalities for which they are credentialed and privileged. Privileges at the CMCVAMC will terminate at the time of contract termination or expiration. The Contractor will be required to maintain records that document competence/performance levels of Contractor personnel working on this contract in accordance with JCAHO, and other regulatory body requirements CMCVAMC may request the personnel records of any employee providing services under this contract for competency review. The VA reserves the right to request copies of current certifications and/or licenses at any time during the duration of the contract. LIABILITY Contract Radiologist is responsible for the accuracy of their reports. Contract Radiologist are responsible for the accuracy of preliminary reports and notifications made directly to clinicians. Contract Radiologists must carry their own malpractice insurance. Coverage for malpractice claims is required when final reports are provided, and when notifications or preliminary reports are communicated directly to non-Radiologist clinicians. 14. SPECIAL CONTRACT REQUIREMENT Services: The services specified herein of this Work Statement may be changed by written modification to this contract. The modification will be prepared by the VA Contracting Officer. The services to be performed by the contractor will be performed in accordance with VA policies. The services performed by the contractor will be under the direction of the Chief of Staff, and the Chief of Imaging Services. 15. RESPONSIBILITY OF THE CONTRACTOR The Contractor must obtain authorization from the Contracting Officer for any services required outside the scope of work provided herein. 16. PERSONNEL POLICY The Contractor shall assume full responsibility for the protection of its personnel furnishing services under this contract in accordance with the personnel policy of the Contractor, such as providing worker s compensation, professional liability insurance, health examinations, income tax withholding, and social security payments. Workers compensation and employer s liability insurance. 17. Reports are to be completed and verified within timeliness metrics. Stat reports must be communicated to requesting clinicians within one hour of when the contract Radiologist receives request. All critical/emergent exam results must be called to requesting clinician and this communication must be documented in the final report (clinician name, date, and time). 95% Compliance Acceptable Quality Level COR will monitor Zero tolerance for violations Adheres to all HIPAA requirements Standard is zero breaches of HIPAA requirements Adequate Coverage 100% Acceptable Quality Level COR will monitor. Zero tolerance for violations. The Government will periodically evaluate the Contractor s performance by appointing a representative(s) to monitor performance to ensure services are received. The Government may inspect each task as completed or increase the number of quality assurance inspections if deemed appropriate because of repeated failures or because of repeated customer complaints. Likewise, the Government may decrease the number of quality assurance inspections if performance dictates. CMCVAMC Quality Assurance Personnel will validate any complaints and report to the Government Contracting Officer who will then take necessary action to enforce contract compliance. If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be correct by re-performance, the Government may result in contract termination. 18 CONTRACT MONITORING CMCVAMC will appoint a Contracting Officer Representative (COR) upon award of this contract. Pursuant to the Delegation of Authority to be issued, the COR will be responsible for verifying contract compliance. 19. Monitors of Clinical Performance: Peer review of interpretations may be performed periodically. Errors in interpretation or incompleteness in documented communication of urgent findings may be aggregated and compared to other Radiologists. Complaints and compliments regarding interactions with other care givers, availability and responsiveness and usefulness of consultations may be reviewed. Timeliness of teleradiology STAT results notification, and report verification will be monitored. Radiologists are expected to participate in focus reviews and morbidity and mortality reviews of those incidents in which they provided care. The COR s will periodically evaluate workload accomplished during the contact period to ensure necessary services are consistently provided. After contract award, any incident of contractor noncompliance shall be forwarded immediately to the Contracting Officer. 20. PAYMENTS The Contractor will submit all invoices electronically by creating an account with Tungsten. This account must be created by calling the Financial Service Center (FSC) at 877-353-9791 and choosing option 3. Once the Tungsten account has been set up and services have been performed the contractor will submit one invoice each month for image interpretations and procedures performed for diagnostic imaging services at CMCVAMC. The Contractor will be paid within 30 days of the approved invoice. Contractor shall be solely responsible for compensating physicians and all employees or contractors who perform services here under, making all tax withholdings, including paying such payroll or other employment related taxes, as required by law. This contract is projected to start no later than 60 days after the contract award and be effective for twelve months. The contract is subject to availability of VA funds. Pricing will be based on a flat fee for type of procedure. Once invoice will be submitted for interpretations performed monthly. 21. PERIOD OF PERFORMANCE CMCVAMC is requesting the period of performance to be for a total of 3 annual Ordering Periods after the date of award. Each Ordering Period will be estimated at 832 hours. HOURS OF WORK: The Contractor as defined herein shall furnish the serviced covered by this contract during normal business hours Monday through Friday, and intermittently at other times and dates. National Holiday: The holidays observed by the Federal Government are: New Year Day, Martin Luther King s Birthday, President s Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, And Christmas Day. 22. CONFIDENTIALITY The contract Radiologist understands and agrees that the information in the medical records of all patients is confidential. Strict confidentiality is to be maintained: Rules of Confidentiality expected to be conformed with are delineated in 38 USC. 3301, 38 USC 4132, 5 USC 552 (a) et. Seq. The contract Radiologist shall be held liable in the event of breach of confidentiality. Any person who knowingly or willingly discloses confidential information from CMCVAMC, may be subject to fines. The contract Radiologist will be HIPAA compliant. The contract Radiologist will comply with all confidentiality rights regarding patient information contained in patient medical records. Any disclosure of protected health information will be limited to that portion of the medical record needed to fulfill the specific purpose of the disclosure. Unless expressly authorized by the patient of the patient s duly appointed and authorized representative, the CMCVAMC will not release any records regarding psychiatric care, alcoholism/alcohol abuse, drug abuse, HIV virus or H IV virus test results. The CMCVAMC will be solely responsible for securing, verifying, and approving authorization for the reproduction of regards regarding psychiatric care, alcoholism/alcohol abuse, drug abuse, HIV virus or HIV virus test results. The contract Radiologist assumes no responsibility for any losses or liability that result, directly or indirectly, from inaccurate information, incorrectly dated material, insufficient or improper authorization, or any type of faulty medical record documentation furnished by the CMCVAMC. The contract Radiologist will not provide copies of health information to any person other than the authorized party. Upon request, the contract Radiologist will undergo all HIPAA/confidential related training and comply with all rules and regulations regarding protected health information. Contract Radiologist represents and warrants that it complies with applicable electronic data transmission standards required by the U.S. government agencies for transmission of protected health information. The contract Radiologist maintains an errors and Omissions liability insurance policy which insures against a negligent act, error, or omission and the oral or written publication of material that violates a person s rights of privacy. The contract Radiologist also maintains a Commercial General Liability Policy. Evidence of coverage will be provided to the CMCVAMC credentialing departments upon request. 23. COMPUTER SYSTEM SECURITY: The contract Radiologist shall provide CMCVAMC with the full assurance that security measures have been implemented which are consistent with Veterans Affairs Standards. In accordance with the Federal Information Security Management Act (FISMA), the Privacy Act of 1974, as amended, the Health Insurance Portability and Accountability Act of 1966 (HIPAA), as applicable, and Public Law 109-461, 5725, contractor access to VA information and information systems must be maintained at the highest level of protection in order to thwart unauthorized disclosure of sensitive information (as defined in VA Handbook 6500, Information Security Program). Federal Acquisition Regulation part 2.101 provides the following definition of contract. Contract means a mutually binding legal relationship obligating the seller to furnish the supplies or services and the buyer to pay for them. It includes all types of commitments that obligate the Government to an expenditure of appropriated funds and that, except as otherwise authorized, are in writing. In addition to bilateral instruments, contracts include (but are not limited to) awards and notices of awards; job orders or task letters issued under basic ordering agreements; letter contracts, orders, such as purchase orders, under which the contract becomes effective by written acceptance or performance; and bilateral contract modifications. Contracts do not include grants and cooperative agreements covered by 31 U.S.C. 8301, et. Seq. Per OMB M-07-19, FY 2007 Reporting instructions for FISMA and Agency Privacy Management, there are five primary categories of contractors as they relate to securing systems and information: 1) service providers, 2) contractor support, 3) Government owned, contractor operated facilities, 4) laboratories and research centers, and 5) management and operating contracts. The requirements document provides standardized security/privacy requirements for VA contractors that support activity involving access to, and use of, sensitive information across the Department. 24. SECURITY REQUIREMENTS Contract Radiologists shall ensure the confidentiality of all patient and employee information and shall be held liable in the event of breach of confidentiality according to federal regulations contained in HIPPA. Any person, who knowingly or willingly discloses confidential information from the CMCVAMC, may be subject to fines up to $50,000.00 and may be subjected to civil litigation from the patient. Background Investigations: Contract Radiologist performing work under this contract shall satisfy all requirements for appropriate security eligibility in dealing with access to sensitive information systems belonging to or bine used on behalf of the Department of Veterans Affairs. To satisfy the requirements of CMCVAMC a minimum background investigation will be conducted prior to performing work under this contract. The level of access and the individual s capability to perform work under this contract will be the determining factor in deciding if a higher investigative requirement is needed. The contract Radiologist shall ensure that those requirements are fully satisfied within 30 days of initiation of such investigations. The investigation history for Contractor(s) personnel working under this contract must be maintained in the databases of either with the Office of Personnel Management (OPM) or the Defense Industrial Security Clearance Organization (DISCO). Should the Contractor(s) use another vendor other than OPM or Defense Security Service (DSS) to conduct the investigation, the investigative company must be certified by OPM/DSS to conduct Contractor(s) investigations. The Contractor is expected to maintain a Drug-free Workplace in accordance with Federal regulations. The Contractor will establish and maintain a drug-free workplace program. The administration of this program will be the responsibility of the contractor, as well as the establishment of disciplinary actions. All costs associated with obtaining clearances for Contractor(s) provided personnel will be the responsibility of the Contractor(s). Further, the Contractor(s) will be responsible for the actions of those individuals they provide to perform work for the VA under this contract. If damages arise from work performed by Contractor(s) provided personnel, under the auspices of this contract, the Contractor(s) will be responsible for all resources necessary to remedy the incident. Records: Contractor(s) personnel who obtain access to hardware or media which may manipulate or store drug or alcohol abuse data, sickle cell anemia treatment records, records or tests or treatment for or infection with HIV, medical quality assurance records, or any other sensitive information protected under 38 U.S.C. §4132 or §3305, as defined by the Department of Veterans Affairs, shall not have access to the records unless absolutely necessary to perform their contractual duties. Any individual who has access to these data will disclose them to no one, including other employees of the Contractor(s) not involved in the performance of the contractual duty for which access was obtained. Violation of these statutory provisions, as stated in department regulations by the Contractor(s) s employees may involve imposition of criminal penalties. System of Records: The Veterans Administration system(s) of records to which the Contractor(s) personnel will have access to maintain is Patient Medical Records VA (24VA136). System Security: The Contractor(s) shall provide VHA with full assurance that security measures have been implemented which are consistent with VA Departmental Standards Procedures for User Access: Access requirements to VA information systems by Contractor(s)s and Contractor(s) personnel shall meet or exceed those requirements established for VHA employees as described in VHA Directives (and others) and in any subsequent VHA policy statements. A written and signed request for user access by VHA Management, or designee(s), constitutes management approval (sponsorship) to initiate a request for access to any sensitive automated information system. Access shall be granted to non-VA users only if the purpose for access meets criteria of the Privacy Act and VA Confidentiality regulations and transfer. Contractor(s) will be required to sign and abide by the VA National Rules of Behavior. 25. KEY PERSONNEL AND TEMPORARY EMERGENCY SUBSTITUTIONS: The Contractor shall assign to this contract key personnel to perform services. During the first ninety (90) days of performance, the Contractor shall make NO substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer, in writing, within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (b) below. After the initial 90-day period of the contract, the Contractor shall submit the information required to the Contracting Officer at least 15 days prior to making any permanent substitutions. The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes shall have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on the proposed substitutes. The contract will be modified to reflect any approved changes of key personnel. For temporary substitutions where the key person will not be reporting to work for two days, the Contractor will provide a qualified replacement for the key person. This substitute shall have comparable qualifications to the key person. Any period exceeding one week will require the procedure as stated above. All Temporary Substitutions must have prior credentialing and privileging at the VA facility. End of Statement of Need (SON) Instructions to Vendors: The information identified above is intended to be descriptive, of the Temporary Radiologist Staffing requirement, to indicate the quality of services that will be satisfactory. It is the responsibility of the interested source to demonstrate to the government that the interested parties can provide the supplies/services that fulfill the required specifications mentioned above.
